We manufacture in our own factory in Maramureș, Romania, and sell directly to customers in the United Kingdom. There is no UK retailer or intermediary between us and you.
Where these terms apply
These terms apply to consumers buying for purposes wholly or mainly outside a trade, business, craft or profession. If you are buying as a business, the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 do not apply to you and different terms are available on request.
How a contract is formed
Placing an order is an offer to buy. We confirm receipt by email — that acknowledgement is not acceptance. The contract is formed only when we send you a dispatch confirmation. If we cannot supply an item (for example a made-to-measure size we cannot cut, or a pricing error), we will tell you and refund any payment in full.
Prices, VAT and import charges
All prices are shown in pounds sterling and include UK VAT and all import duties. We ship on a Delivered Duty Paid basis. There is nothing further to pay when your order arrives — no customs charge, no courier handling fee, no VAT invoice at the door.
Delivery to the UK mainland is free on every order. See our Delivery policy for excluded postcodes.
Prices can change, but never after we have accepted your order. Where a product is shown with a previous price, that price was the price we actually charged for at least 28 consecutive days in the six months before the reduction.
Made-to-measure orders
Mattresses cut to your own dimensions are made to your specification. Under regulation 28(1)(b) of the Consumer Contracts Regulations 2013 the 14-day cancellation right does not apply to goods made to a consumer's specification or clearly personalised. You can still cancel before we begin cutting — contact us as quickly as possible. Made-to-measure orders are excluded from the 100-night trial.
Your statutory rights if a made-to-measure mattress is faulty, not as described, or not the size you specified are unaffected.
Your legal rights over the goods
Under the Consumer Rights Act 2015 everything we sell must be of satisfactory quality, fit for purpose and as described. If it is not:
- within 30 days of delivery you may reject it and get a full refund;
- after 30 days and within six months you may ask for a repair or replacement, and if that fails, a refund or price reduction;
- after six months the same remedies are available, but you may be asked to show the fault was present at delivery.
These rights sit alongside our guarantee and the 100-night trial. Neither replaces them, and nothing in these terms limits them.
Cancellation
You have 14 days from the day you receive your order to change your mind, and a further 14 days to send the goods back. Full details, including who pays for return carriage and the exceptions that apply to unsealed hygiene items, are in our Returns, refunds and cancellations policy, which forms part of these terms.
Delivery and risk
Risk passes to you when the goods are delivered to the address you gave us. Ownership passes when we have received payment in full. If nobody is available and the goods are returned to us, we may charge the actual cost of a second delivery attempt.
Fire safety
All mattresses we sell to the UK meet the Furniture and Furnishings (Fire) (Safety) Regulations 1988 and carry a permanent BS 7177 label. Do not remove that label.
Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. We are not liable for business losses.
Events outside our control
If something beyond our reasonable control delays or prevents delivery, we will contact you as soon as possible. If the delay is substantial you may cancel and receive a full refund.
Complaints and disputes
Email customers@cadarbeds.co.uk with your order number. We aim to acknowledge within one working day and resolve within 14 days. We are not currently a member of an alternative dispute resolution scheme and are not obliged to use one, but we will always try to reach a fair outcome directly.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. Nothing here removes any protection you have under the mandatory consumer law of the part of the United Kingdom where you live, and you may bring proceedings there.
Other terms
We may update these terms; the version in force is the one published when you place your order. If any part is found unlawful, the rest continues to apply. We may transfer our rights and obligations under the contract, and will tell you in writing if we do.
